Welcome to Focliy — India's first value exchange platform. These Terms & Conditions govern your use of Focliy's website, mobile services, and membership benefits. By creating an account or purchasing a membership, you agree to be bound by these terms.
1 Acceptance of Terms
By accessing or using Focliy's platform, purchasing a membership, submitting hair, tracking rides, or redeeming credits, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
If you do not agree to these terms, please do not use our platform or purchase a membership. Focliy reserves the right to modify these terms at any time. Continued use after changes constitutes acceptance of the updated terms.
2 Eligibility
To use Focliy's services, you must:
- Be at least 18 years of age, or 13+ with parental consent for supported plans
- Be a resident of India
- Provide accurate, complete, and current registration information
- Have a valid phone number for WhatsApp communication
- Not be a previously terminated member unless re-approved by Focliy
Focliy reserves the right to verify identity and eligibility at any time and to refuse or revoke membership for any user who does not meet these requirements.
3 Membership Plans
Focliy offers several membership tiers with different benefits and price points. Key terms:
- Annual membership — Plans are valid for 12 months from the date of activation by our team.
- Non-refundable — Membership fees are non-refundable once the account has been activated and benefits accessed.
- Approval required — All memberships are subject to admin approval. Payment alone does not guarantee activation.
- One account per person — Members may not hold more than one active membership account.
- Non-transferable — Memberships and earned credits are personal and cannot be transferred to another person.
- Renewal — Members will be notified before expiry. Lapsed memberships do not carry credits forward unless renewed within 30 days.
4 Earning Credits
Members earn Focliy credits through approved activities:
- Bike Rides — Credits are calculated based on verified GPS-tracked distance. Only rides tracked through the platform's ride-tracking feature qualify.
- Hair Submissions — Credits are awarded based on the quality and quantity of naturally fallen hair submitted through Focliy's official collection process.
- Referrals — Credits may be awarded for referring new paid members (subject to the referral programme terms in force at the time).
All credit awards are subject to admin review and approval. Focliy may adjust credit rates, earning caps, and qualifying criteria at any time. Credits have no cash value and cannot be exchanged for money.
5 Redemption of Credits
Approved members may redeem credits for beauty services, grocery vouchers, travel, hotel stays, and bike servicing through Focliy's verified partner network. Redemption terms:
- Credits can only be redeemed at verified Focliy partner outlets.
- Redemption is subject to partner availability and capacity.
- Credits expire 30 days after membership expiry if not renewed.
- Focliy does not guarantee the availability of any specific service at any specific time.
- Partial redemptions are permitted; unused balance remains in the wallet.
6 Hair Submission Policy
Focliy accepts only naturally fallen hair — hair that has shed on its own without deliberate cutting. Submission guidelines:
- Hair must be clean, dry, and free from chemical treatments where possible.
- Minimum submission weight or quantity as communicated by our team applies.
- Deliberate cutting of hair to increase submission volume is prohibited and will result in account suspension.
- Once hair is submitted and collected, it becomes the property of Focliy for use in its circular economy operations.
- Credit amounts for hair are assessed by our team after inspection; the assessed value is final.
7 Ride Tracking
Ride credits are only earned through the platform's official GPS-based tracking feature. By using ride tracking, you agree:
- All rides must be genuine, physically completed bicycle rides.
- Manipulating GPS data, using emulators, or any other means to falsify ride distance is strictly prohibited.
- Minimum ride distance thresholds apply (currently 0.1 km per ride).
- All tracked rides are subject to admin review before credits are awarded.
- Focliy may use GPS data to verify ride authenticity and will reject rides that appear implausible.
- Focliy is not responsible for inaccuracies in GPS tracking caused by device or network conditions.
8 Prohibited Activities
The following activities will result in immediate account suspension and potential legal action:
- Creating multiple accounts to gain additional credits
- Falsifying ride distances or GPS data
- Submitting purchased, cut, or third-party hair as your own naturally fallen hair
- Attempting to resell, transfer, or broker credits
- Circumventing Focliy's approval or verification processes
- Using the platform for any unlawful purpose
- Harassing staff, partners, or other members
Focliy reserves the right to cancel membership and forfeit all credits without refund in the event of violations.
9 Privacy Policy
Focliy collects personal data necessary to provide its services, including name, phone number, location data (during rides), and payment details. We use this data to:
- Operate and improve the Focliy platform
- Process memberships, credit awards, and redemptions
- Communicate with you via WhatsApp and email
- Comply with legal obligations
We do not sell your personal data to third parties. Location data from ride tracking is stored securely and used only for credit calculation and fraud prevention. You may request deletion of your account and data by contacting connect@focliy.in.
10 Limitation of Liability
To the fullest extent permitted by law:
- Focliy is not liable for any indirect, incidental, or consequential damages arising from use of the platform.
- Focliy does not guarantee uninterrupted service or the continued availability of any partner or service category.
- Ride activities are undertaken at your own risk. Focliy is not responsible for injuries, accidents, or third-party liability arising from bike riding.
- Partner service quality is the responsibility of the respective partner outlet. Focliy will mediate disputes in good faith but cannot guarantee outcomes.
Our total liability to you in connection with any claim shall not exceed the membership fee you paid in the most recent membership year.
11 Termination
Focliy may terminate or suspend your account at any time for breach of these terms, fraudulent activity, or at our sole discretion. You may close your account by contacting us in writing.
On termination:
- Access to membership benefits ceases immediately.
- Unused credits are forfeited and cannot be redeemed or refunded.
- Membership fees already paid are non-refundable.
- Any pending credit awards under review are cancelled.
